Acordă termen la data de 18.01.2024, sala 174, complet C2NS/MA, ora 11:00, în şedinţă publică, pentru punerea în discuţie a propunerii de închidere a procedurii. Practicianul în insolvenţă are obligaţia de a depune la dosarul cauzei, cel mai târziu cu 7 zile anterior termenului de judecată, dovada publicării în Buletinul Procedurilor de Insolvenţă a raportului cu propunerea de închidere a procedurii. Totodată, pune în vedere practicianului în insolvenţă să se prezinte (sau să delege un reprezentant care să se prezinte) periodic la Serviciul Arhivă, să verifice şi să ridice de la dosarul cauzei duplicatele cererilor, dacă acestea există în duplicat, dacă nu să solicite copii de pe acestea, să le analizeze şi să ia măsurile ce se impun, măsurile luate să le insereze într-un raport pe care să-l comunice cu petenţii şi să îl publice în Buletinul Procedurilor de Insolvenţă, dovezile de comunicare, respectiv de publicare în Buletinul Procedurilor de Insolvenţă urmând a le depune la dosar. Pune în vedere practicianului în insolvenţă că cererile trebuie depuse în conformitate cu art. 41 alin. 4 din Legea 85/2014 rap. la art. 194 Cod procedură civilă separat de raport, iar neîndeplinirea culpabilă a obligaţiilor prevăzute de lege sau stabilite de judecătorul sindic poate duce la aplicarea unei amenzi. Dispune citarea creditorilor prin Buletinul Procedurilor de Insolvenţă, potrivit art. 174 din Legea 85/2014, cu menţiunea că va fi pusă în discuţie propunerea de închidere a procedurii şi de a preciza dacă înţeleg să avanseze fondurile necesare continuării procedurii. Dată în Camera de consiliu şi pronunţată prin punerea soluţiei la dispoziţia părţilor prin mijlocirea grefei instanţei, la data de 16.11.2023.
